An Individual Transitional Employment Agreement (ITEA) is a special transitional instrument which is available during the transition to a new workplace relations system. It is an individual written agreement between an employer and an employee setting out the terms and conditions of the employee's employment.

The employee can ask someone to help them talk to an employer about making, varying or terminating an ITEA. This person is called a bargaining agent and should be appointed in writing, with a copy provided for their employer.TheĀ employer can also appoint a bargaining agent.

Before you sign an Individual Transitional Employment Agreement (ITEA), make sure your employer has given you a copy of the agreement and an information statement from the Workplace Authority that explains its terms and conditions.

After careful consideration of your ITEA, it may be that some renegotiation may be necessary. Remember you do not have to sign an ITEA unless you are completely satisfied with its contents.

As stated above, once your application is lodged by your employer with the Office of the Employment Advocate, the AWA becomes legally binding.

If after the ITEA was lodged you reflect on the process and believe you were given false or misleading information, experienced coercion or duress during the agreement making process, or the ITEA was lodged without your approval you can contact the Workplace Ombudsman.
